ULTIME FIT Service Terms of Use

1. Subscription Terms

1.1 Except in the case of an annual subscription, the monthly ULTIME FIT subscription renews each month until terminated. The contract duration does not exceed one year. To use the ULTIME FIT service, the user must have Internet access and provide a valid and accepted payment method, which may be changed from time to time. Unless the user cancels their monthly subscription before the monthly billing date, they authorize ULTIME FIT to charge their next month's subscription according to the established payment method until the first anniversary of the first day of subscription (for cancellation details, refer to clause 3 'Cancellation').

1.2 ULTIME FIT may offer different types of subscriptions, including certain special promotional subscriptions. These subscriptions may have their own different terms and restrictions, which will be communicated to the user during registration or through other communication, such as an email message. To view information regarding ULTIME FIT subscription, the user must click on 'My Account' at the top right of the ULTIME FIT website homepage, then on 'Subscription Information'.

2. Free Trial Terms

2.1 Any ULTIME FIT subscription begins with a free trial of the platform. This free trial period lasts seven (7) days, or for the duration indicated during registration, and is intended to allow new users to try the service before being charged.

2.2 ULTIME FIT reserves the right to reduce the duration and even cancel the free trial for users whose use of this offer is deemed excessive. ULTIME FIT reserves the right to suspend a user's account if they are not eligible. ULTIME FIT may use information such as device identification number, payment method, or email address associated with an ULTIME FIT subscription to determine user eligibility.

2.3 The 7-day free trial is valid only once per person, per email address.

3. Billing and Cancellation Terms

3.1 ULTIME FIT service subscription fees and other fees related to service use, such as taxes, will be charged annually or monthly, according to the established payment method, on the corresponding day at the beginning of the paid subscription period. To find out the next payment date, the user must click on 'Subscription Information' on the 'My Account' page.

3.2 To use the ULTIME FIT service, a valid payment method must be used. This payment method can be updated by accessing the 'My Account' page. ULTIME FIT may update the payment method using information provided by payment service providers. Once an update is made, the user authorizes ULTIME FIT to continue charging with the applicable payment method. The user is responsible for unpaid amounts. If a payment is not settled due to expiration date, insufficient funds, or any other reason and the account remains open, ULTIME FIT reserves the right to deny access to the ULTIME FIT service until a valid payment method is restored.

3.3 The user can cancel their ULTIME FIT subscription at any time. In the case of a monthly subscription, they will maintain access to the ULTIME FIT service until the end of their billing cycle. No refunds will be given. In the case of an annual subscription, cancellation will automatically result in account closure. Where permitted by applicable law, payments are non-refundable and no refunds or credits for any unused subscription period may be granted (see clause 3.5. for a new Nautilus Plus member). In the case of an annual subscription, notwithstanding the foregoing, the user may, at their discretion, terminate the contract (i) without charge or penalty before ULTIME FIT begins to perform its principal obligation, and (ii) within a period equal to one-tenth of the expected duration of the contract, from the time ULTIME FIT begins to perform its principal obligation, in which case ULTIME FIT may not require payment of an amount greater than one-tenth of the total price specified in the contract. The user may cancel the annual subscription by following the procedure indicated on the 'My Account' page, or by means of the form provided for in section 199 of the Consumer Protection Act, or other written notice to that effect to info@ultimefit.com. Details about account closure are indicated in the 'Subscription Information' section on the 'My Account' page.

3.4 If a promotional code was applied when purchasing a subscription, the discount value granted by the promotional code cannot be applied when renewing the subscription.

4. ULTIME FIT Service Content Terms

4.1 The ULTIME FIT service and content viewed as part of the service are intended exclusively for personal and non-commercial use. During the ULTIME FIT subscription period, the user has a limited, non-exclusive, and non-transferable right giving them access to the ULTIME FIT service.

4.2 The ULTIME FIT service, including its video and recipe content, is regularly updated.

4.3 The user agrees to use the ULTIME FIT service appropriately in compliance with applicable laws and regulations. The user agrees not to archive the content and information contained in the ULTIME FIT service, nor to reproduce, distribute, modify, display, perform, publish, license for use, create derivative works from, offer to sell or use them (except as expressly authorized by these terms of use). The user agrees not to circumvent ULTIME FIT service content protection measures and not to modify, disable, damage or counteract them, not to use robots, web crawlers, web harvesting tools or other automated methods to access the ULTIME FIT service, not to decompile, reverse engineer or disassemble any software or other product or process accessible through the ULTIME FIT service, not to insert any code or product nor manipulate the ULTIME FIT service content in any way whatsoever and not to use any data exploration, collection or extraction method. ULTIME FIT reserves the right to cease or restrict access to the service if a user violates the above provisions, the terms of use or makes illegal or fraudulent use of it.

4.4 The quality of ULTIME FIT content image and display may vary from device to device, and according to various factors, such as user location and bandwidth and/or Internet connection speed. Access to HD (high definition) and Ultra HD (ultra high definition) depends on Internet access and device capabilities. HD or Ultra HD format is not available for all videos. The user is responsible for fees associated with Internet access.

4.5 ULTIME FIT software was developed by Nautilus Plus and is designed to allow viewing of its content on devices compatible with ULTIME FIT.

5. Privacy and Account Access Clause

5.1 The user (the person who created the account and whose payment method is used for billing) is responsible for access to the ULTIME FIT account and any activity performed through the ULTIME FIT account. To maintain account control and prevent anyone from accessing it, the user must maintain control and must not reveal to anyone the password or payment method details associated with the account. The user is also responsible for providing up-to-date and accurate personal information and payment method. ULTIME FIT reserves the right to terminate or suspend an account to protect the user from identity theft or any other activity deemed fraudulent.

6. Warranty and Limitation of Liability Clause

6.1 The ULTIME FIT service is provided 'as is' and without warranty or condition. The user waives the right to claim damages against ULTIME FIT. These provisions do not limit warranties and rights that cannot be waived.

7. Miscellaneous Clauses

7.1 ULTIME FIT does not accept any unsolicited material or ideas for its content and is not responsible for any future resemblance of its videos, programs or recipes on any medium to material or ideas that may have been transmitted to it.

7.2 If the user has questions or wishes to learn more about the ULTIME FIT service, they can send an email to info@ultimefit.com.

7.3 If one or more clauses mentioned above in the terms of use are deemed invalid or illegal, the validity and legality of other clauses will remain in effect.

7.4 ULTIME FIT may modify the terms of use clauses. ULTIME FIT undertakes to notify its users at least 30 days before changes are applied.

7.5 ULTIME FIT will send information about the user's account, such as payment authorizations, invoices, password or payment method changes, confirmation messages and notices, electronically, to the email address provided by the user during registration.

8. Liability

8.1 As any exercise program carries health risks, a visit to the doctor is necessary before beginning. To reduce the risks of injury inherent in any physical activity, the user must respect their limits and stop the activity at the first signs of discomfort or pain.

8.2 People who contributed to the production of this product disclaim all liability for negative health effects resulting from the practice of exercises or application of advice provided.
